(Cover) - EN Showbiz - Ashlee Simpson and Pete Wentz are headed towards a custody battle for their son, it has been reported.
Fall Out Boy rocker Pete is believed to have filed legal papers at the Los Angeles County Superior Court yesterday, where he demanded joint physical and legal custody of two-year-old Bronx, according to TMZ. The papers were a response to the divorce petition filed by Ashlee, in which she indicated that she wants primary physical custody of their child and visiting rights for Pete. It has been claimed Ashlee has also asked for spousal and child support.
Pete has reportedly requested that he and Ashlee pay their own legal fees, in response to Ashlees demand that 31-year-old Pete covers the costs for both sides.
In the papers filed by Pete, it is revealed the couple split on February 9 just days after he returned from watching the Super Bowl in Dallas without Ashlee.
The pair who tied the knot in May 2008 - announced their split last month, but vowed to remain on good terms for the sake of their son.
"After careful consideration, we have made the difficult decision to file for divorce," the couple said in a statement. "We remain friends and deeply committed and loving parents to our son Bronx, whose happiness and well-being remains our number one priority. We ask that everyone honour our privacy as we navigate this next phase of our lives."
No reason has been given for the break-up, but it has been reported that Ashlee initiated divorce proceedings after becoming frustrated with Petes hectic touring schedule. (C) Cover Media
