Kris Humphries plans to file for legal separation from estranged wife Kim Kardashian, it is reported.
The basketball player's rep confirmed that the athlete plans on responding to Kim's divorce proceedings, which she started just 72 days after they got married, with his own bombshell.
People magazine reports that Kris ultimately wants to have the marriage annulled so any record of them ever being married will be cleared.
Soon after Kim filed for divorce on Halloween citing irreconcilable differences, Kris said he wanted to fight for the marriage and then it was claimed he was going to sign the divorce papers.
But it appears that Kris now wants to wipe the slate clean and avoid divorce proceedings all together and not have on his record that he was ever married to the reality star.
However, a legal expert told the publication that it can be hard to obtain an annulment and that he will have to prove that fraud was committed.
Family lawyer Scott Weston, who does not represent either party, said that Kim would probably fight Kris on the matter "unless she's willing to agree that she defrauded him" which could result in a nasty court battle.
"Kris is sensitive to marriage both emotionally and religiously, a source told the magazine. "He went into it in good faith and never expected things to turn out this way."
Kris, 26, is said to be upset at the way he was portrayed on the season premiere of Kourtney & Kim Take New York over the weekend and was never comfortable being in front of the cameras.
His career is starting to look up again now that the NBA lockout has ended and he can now focus on getting back to work. He has also recently signed a $150,000 endorsement deal with Sector watches.
Kris is being portrayed as the bad guy in the show while Kim is being painted as the innocent party, likely because she has creative control over the final edit.
But friends have told Us Weekly that Kris was sometimes cruel to his wife and they are not surprised the marriage failed.
"He belittled her in front of people," the insider said. "He'd call her stupid. It was truly sickening."
