Katie Holmes marriage to Tom Cruise had reportedly "broken down irretrievably" six months before she filed for divorce.
Court papers obtained by the National Enquirer reveal the couple had been living separate lives for some time. The documents are dated August 17 2012 and are signed by New York State Supreme Court Judge Matthew F. Cooper.
According to the publication, the legal papers state the "marital relationship" had "broken down irretrievably for a period of at least six months immediately preceding."
The documents also offer new details about their relationship. Despite their lavish wedding in Italy in 2006, Tom and Katie were officially married in a civil ceremony in Los Angeles in November 2006.
The pair apparently agreed a pre-nuptial agreement some months before the nuptials.
The legal papers also include information about the custody arrangements for the couple's six-year-old daughter Suri.
Tom must pay $400,000 a year to cover Suri's "medical, dental, insurance, unreimbursed medical and dental, education, college, extracurricular and camp expenses."
This payment will continue until Suri turns 18 and in total will set Tom back an estimated $4.8 million.
