SC refuses to stay trial proceedings in Jiah Khan case

Jiah Khan's suicide case is becoming complicated with each passing day. Every single day witnesses some new twists and turns.

Jiah's mother Rabiya Khan earlier claimed that the Supreme Court is doing their work in an improper way and also pointed out the absence of a special public prosecutor in her daughter's suicide case. She also said that the court should stay on the trial proceedings until the Bombay High Court takes the decision on her plea for SIT probe.

Supreme Court denied to stay the trial proceedings and instead asked Rabiya to approach the High Court for early hearing for the SIT probe. According to Rabiya Khan the court was not doing the investigation in the proper way and has failed to recover messages/Sms which were exchanged by Jiah and her alleged boyfriend actor Sooraj Pancholi.

Senior advocate Jayant Bhushan, appearing for Khan, told justices A M Sapre and Ashok Bhushan that , "It is submitted that the judge has completely failed to appreciate, the well settled law as has been laid down by the court, that the interim orders granted cannot be vacated mechanically and without assigning any reason and ordinarily the same should be extended in the petition is disposed of on merit."

Rabiya Khan challenged the High Court order claiming that it is 'mechanically passed' and entitled it as "absurd."
